Six Democratic US lawmakers are pressing the Director of National Intelligence to disclose whether Americans using commercial VPN services risk losing their constitutional protections against warrantless surveillance. Because VPNs mask the origin of traffic, intelligence agencies under Section 702 of the Foreign Surveillance Act may treat US citizens' traffic as foreign, inadvertently subjecting them to the same warrantless surveillance programs targeting foreigners. This creates a paradox where following government agencies' own advice to use VPNs for privacy may actually strip Americans of their legal privacy protections.
